The present general terms and conditions of sales define the rights and obligations of the Client on the sales sites www.pinkpoint.org the framework of distance selling.

ARTICLE 1
The present general terms and conditions of sales govern the contractual agreement between Pink Point and its client, whereby the two parties accept without reservation. These general terms and conditions of sales will prevail over all other conditions appearing in any other documents, unless a prior written derogation is received. The acceptance of these general terms and conditions of sales is confirmed by the payment of the order. No disputes concerning the general terms and conditions of sales can be raised once the payment of the order has been executed.
ARTICLE 2
Our prices are inclusive of VAT but exclude the cost of delivery. The prices mentioned on the website can be changed without notice. The price to be paid will be the price stated on the website when the order is placed, at the time of the confirmation of the order (confirmation and acceptance of payment on our website). The price of our products and the cost of delivery can be changed on the website without prior notice.
ARTICLE 3
The articles are described on our website according to our database and to information received from the suppliers of these products. The information provided on our website is the information that is in our possession at the time of the placement of your order. Pink Point can not be held responsible if variances exist between the products delivered and the photos of the products published on the website. The selection and purchase of the products are the client’s responsibility. Pink Point will not be held responsible if the product purchased is not usable, whatever the cause may be. The products offered by Pink Point are in compliance with the Dutch legislation in force at the time of sale of the product and will not be held liable should the products not comply with the legislations in force in the countries where the products are delivered. It is the client’s responsibility to verify with the local authorities that the products or services that he is planning on ordering are in compliance with the countries legislation.
ARTICLE 4
Payment will be carried out as explained hereunder, except in the case of a special prior agreement: By secured payment via paypal.com or iDeal. The amount will be debited from your account upon dispatch of your order, if your card is accepted at that time. After placing your order, you will be sent a confirmation notice by email, confirming the amount which must be paid upon dispatch of your order and will be inclusive of all costs. All taxes, VAT, administrative fees and other fees which may be charged in the country where you have requested the delivery of your order will be borne by you.
ARTICLE 5
The offers presented on the site are valid only while stocks last. The product may be in stock or become available at a later date. Products that are permanently out of stock will not be published on our website. However, despite our vigilance, if a product ordered proves to be temporarily or permanently out of stock, we will inform you of its unavailability as soon as possible by email, bearing in mind that if your order contains numerous products, we will deliver the products that are in stock. For products which are not stocked in our warehouses, our offers are valid under reserve of their availability with our supplier. This information is obtained directly from our supplier and thus any eventual errors or modifications are beyond our control and we cannot be held responsible for them. The non-observance of the delivery date cannot give rise to any compensation or cancellation of the order. If your order is not delivered due to the unavailability of the product or due to an Act of God, no compensation can be requested. Pink Point responsibility is limited to the total cost of the order and cannot be held liable for any simple errors or omissions which may occur despite all the precautions taken in the presentation of the product.
ARTICLE 6
Pink Point reserves the right to refuse an order from a client who is in dispute with the company.
ARTICLE 7
The recipient must verify the quantity and state of the products upon delivery. In order for a claim to be valid, all defects must be pointed out to the delivery service at the time of the delivery of the product and explicitly mentioned on the delivery note which must be duly signed. No product may be returned without prior agreement from Pink Point and this agreement in no case implies that Pink Point is accepting responsibility for the returned product.
ARTICLE 8
The buyer has seven calendar days from the time of reception of the order to return the products, at his own costs, to the following:

It is imperative that the returned product is returned in its original packaging, intact, and accompanied by all the accessories (if any), the instruction manual and any documentation included. This also applies to products that are returned in the case of the non-conformity of the product. If this clause is not respected, a deduction of up to 80% of the selling price will be applicable. All returned products must be accompanied by the original purchase invoice, clearly indicating the date of purchase and the product reference as well as the return reference number provided beforehand by Pink Point. Only freight prepaid returned products will be accepted.
ARTICLE 9
In the case of faulty products, Pink Point will refund or replace the faulty products. However, Pink Point will neither replace nor refund a product which is faulty because it has been subject to a shock or has been incorrectly used. It is imperative that the returned product is in its original packaging, and accompanied by all the accessories (if any), the instruction manual and any documentation included, with a note explaining the reasons for the return of the product. Only freight prepaid returned products will be accepted.
ARTICLE 10
Pink Point cannot be held liable for damages of any nature, whether tangible or intangible, or corporeal, which may result following the incorrect use of the products on sale.
ARTICLE 11
Pink Point will, at all times, respect the Dutch laws concerning the privacy of its clients and the personal information provided by clients when carrying out orders on the website. This information will only be used by our internal services when carrying out an order and may also be used to reinforce and personalize communication and special offers reserved for clients of the Pink Point site.
